The creation and interpretation of Wills are a matter of state law. Wills are interpreted according to the state court where they are probated by a judge when the Testator passes away.

There are several major differences in state law. The first major difference is that in the minority of states that observe the Community Property regime Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin , a person may not use their will to disinherit a surviving spouse, who is entitled to at least a portion of the Testator's estate.
